These Terms of Service ("Terms") govern access to and use of Nguvu Fit, a gym management platform operated for Gyms in Kenya. By creating a Gym account, accessing a Gym subdomain, or using the member portal, you agree to these Terms.
If you are creating a Gym account on behalf of a business, you confirm you have authority to bind that business to these Terms. If you are a Gym member using the member portal, your use is also governed by these Terms in addition to any membership agreement with your Gym.
Each Gym that signs up receives a dedicated subdomain (e.g. yourname.nguvu.co.ke) and an isolated database. The Gym is responsible for:
New Gyms may begin on a trial plan. After the trial period, continued use requires an active subscription. Subscription fees, billing cycles, and plan limits are as displayed on our pricing page at the time of purchase.
Failure to pay subscription fees when due may result in restricted access or suspension of the Gym account, subject to any grace period stated at checkout.
Pricing may change with reasonable notice for future billing cycles — existing billing periods are honored at the rate agreed at purchase.
You agree not to:
Members are responsible for keeping their portal PIN confidential and for any activity that occurs through their authenticated session.
Report a lost device or suspected unauthorized access to your Gym immediately so your access can be reset.
Membership and event payments may be processed via M-Pesa, supported banks, or other integrated gateways. These transactions are subject to the respective provider's own terms.
Nguvu Fit facilitates the integration but is not the payment processor of record. Disputes regarding a specific transaction may need to be raised with the relevant provider in addition to your Gym.
As between a Gym and Nguvu Fit, the Gym retains ownership of its member, attendance, and payment data. Nguvu Fit is granted a limited license to host, process, and display that data solely to provide the platform's functionality.
On account closure, a Gym may request export of its data within a reasonable period before deletion.
We aim to keep Nguvu Fit available and performant but do not guarantee uninterrupted access. Planned maintenance will be communicated where practical.
Support channels and response times may vary by subscription plan.
We may suspend or terminate a Gym account for breach of these Terms, non-payment, or unlawful use of the platform.
A Gym may close its own account at any time; outstanding fees for the current billing period remain payable.
To the maximum extent permitted by law, Nguvu Fit is not liable for indirect, incidental, or consequential damages arising from use of the platform, including loss of revenue or data, except where such liability cannot be excluded under Kenyan law.
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Kenya.
